Temporary Skill Shortage Visa Subclass 482

This temporary visa lets an employer sponsor a suitably skilled worker to fill position they can’t find a suitably skilled Australian to fill. This visa enables employer to address labour shortages by bringing in skilled workers where employers can’t source and appropriately skilled Australian worker. TSS visa holders can work in Australia in their nominated occupation and may have pathway to permanent residency.

There are three streams available under the TSS 482 visa:

• Short-term stream -this is for employers to source genuine temporary overseas skilled workers in occupations included on the short -term skilled occupation list (STSOL) for a maximum of two years each time (or up to four years if an international trade obligation applies)
• Medium- term Stream-this is for employers to source highly skilled overseas workers to fill medium-term critical skills in occupations included on theMeduim and long-term strategic skill list(MLTSSL) or the Regional occupation List ( ROL) for up to four years (each time), with eligibility to apply for permanent residence after three years
• Labour Agreement Streams this is for employers to source overseas skilled workers in accordance with a labour agreement with the Commonwealth, on the basis of a demonstrated need that cannot be met in the Australian labour market and standard visa programs are not available, with the capacity to negotiate a permanent residence option.

Temporary Activity Visa

1.Temporary Work (short stay specialist) Visa Subclass 400

The highly specialised work stream of this temporary visa let you do short term, highly specialised work in Australia. It is suitable if you have specialised skills, Knowledge, or experience not generally available in Australia.
Generally, the stay period is up to three months but up to six months may be considered in limited circumstances if supported by strong business case.

2.Temporary Activity Visa Subclass 408

This visa allows you to come to Australia to do specific types of work on short -term temporary basis. This temporary visa lets you come to Australia to participate in event which is endorsed by the Australian Government.

• Work in the entertainment industry
• Participate in activities at the invitation of an Australian organisation
• Participate or observe in an Australian research project
• Work in a skilled position under a staff exchange arrangement
• Participate in high-level sports competitions or sports training programs
• Participate in a special programme approved by the department that provides opportunities for youth exchange, cultural enrichment or community benefits
• Do full-time religious work
• Be employed as a superyacht crew member
• Do full-time domestic work in the household of certain senior foreign executives

3. Training Visa Subclass 407

This visa allows you to take part in workplace- based occupations training activities to improve your skills for you job, area of tertiary study, field of expertise or in professional development training in Australia. This is a temporary visa; Department of home affairs might grant you a visa allowing you to stay in Australia for up to 2 years.

4. Temporary Work (International Relation) Visa Subclass 403

This visa stream allows a person to work in Australia under the terms and conditions of a bilateral agreement between the Australian Government and a government of another country.

Employer Nomination Scheme Visa Subclass 186

This Visa lets skilled worker, Who are nominated by their employer, Live and work in Australia permanently.

A. Direct Entry Stream-is for applicants who have not worked on a 457 visa/ TSS 482 Visa with their nominating employer for two years (3 years for TSS visa holders) but who are formally qualified in their occupation and have worked for at least three years at a skilled level in their occupation and their occupation is on the 186 Visa Occupations List ( Direct Entry) ).

C.Temporary Residence Transition Stream- is for 457 visa /TSS 482 visa holders who have worked for two years/ 3 years for TSS visa( Medium Term), while holding a subclass 457 visa/482 visa, in the same occupation with their nominating employer who wants to offer them a permanent position in that occupation.

Skilled Employer Sponsored Regional (Provisional) Visa Subclass 494

This visa enables regional employers to address identified labour shortages within their region by sponsoring skilled workers where employers can’t source an appropriately skilled Australian Worker Substituting the previous RSMs 187 visa commenced November 16, 2019 the 494 visa has 10,000 places allocated per year.
It requires employer sponsorship and the position must be likely to exist for 5 years. It has a 45-year age limit (exceptions apply), competent English, Regional Certifying Body (RCB) advise, and must meet the market salary. Visa applicants must have a suitable skill Assessment and at least 3 years skilled employment. visa validity period is 5 years. Conditions will be imposed which will enforce the government’s intentions that visa holders live, work and study only in regional areas. (condition 8579) and only in the nominated position. Visa holders must commence work within 90 days of the visa being granted and must only work in your nominated occupation and only work for the nominating employer in regional Australia. If you do not, your visa may be cancelled.
Regional areas are defined as any area excluding Sydney, Melbourne and Brisbane. Holders of the new provisional visas will also be unable to apply for most other skills-based visas in Australia unless they have completed at least three years in a designated regional area, unless exceptional circumstances exist. Additionally, similar to current arrangements for the subclass 457 and 482 visa program, holders of the new provisional visas can be negatively impacted by sponsor non-compliance.

Global Talent Visa- Employer Sponsored (GTES visa).

The Global Talent Employer Sponsored program allows employers to sponsor overseas workers for highly skilled niche positions that cannot be filled:

• By Australian Workers
• Labour Agreement Stream•Through other standard visa programs - in particular, The Short-term stream and Medium-term stream of the Temporary Skill Shortage (TSS) visa

Before the Department enters into an agreement, businesses must be able to demonstrate that they can’t fill the position through existing skilled visa programs.

You will then be able to sponsor workers for a TSS visa under the GTES.

The GTES is designed to benefit Australia and Australian workers.

It aims to bring globally mobile, highly skilled and specialised individuals to Australia who can act as 'job multipliers' in Australian businesses, helping them to hire more local staff and fill critical areas of need.

Any position filled through a GTES agreement must provide opportunities for Australians by, for example:

• Creating New Jobs for Australians
• Transferring Skills and Knowledge to Australian Workers
